TERMS AND CONDITIONS OF THE SERVICE AND DONATIONS

1. General Provisions
 
1.1. These Terms and Conditions (hereinafter: "Regulations") define the types, scope, and conditions of electronic services provided by Fundacja PUS3 Foundation with its registered office in Warsaw (02-001), Al. Jerozolimskie 93, 2nd floor, entered into the Register of associations, other social and professional organisations, foundations and independent public healthcare institutions and the Register of Entrepreneurs of the National Court Register (KRS) under number 0001201917, NIP: 7011283991, REGON: 543090020; e-mail address: info@pus3foundation.org, website: pus3foundation.org (hereinafter: "Foundation" or "Service Provider").
 
1.2. The terms used in the Regulations shall mean:
 
1.2.1. Portal – the Foundation's website, available at pus3foundation.org;

1.2.2. Act on rendering electronic services – Polish Act of 18 July 2002 on rendering electronic services;

1.2.3. Service – services provided electronically by the Foundation as described in Part 2 of the Regulations;

1.2.4. User – any entity using the Services of the Foundation, obliged to comply with the Regulations.
 
1.3. The commencement of use of the Service is tantamount to the acceptance by the User of the terms of the Regulations.

2. Types and Scope of Services
 
2.1. The Regulations apply to the following Services provided electronically:
 
2.1.1. Information Service – providing content regarding the Foundation's statutory activities;
 
2.1.2. Donation Service – providing a mechanism for redirection to external payment operators (payment links) to enable monetary donations to the Foundation;
 
2.1.3. Transfer Data – providing data necessary for making a traditional bank transfer.
 
2.2. Use of the Service is voluntary and free of charge.

3. Donations and Payments
 
3.1. The User may make a monetary donation to support the Foundation's statutory goals using payment buttons (Stripe, PayPal) or via traditional bank transfer.
 
3.2. Payment Operators: Electronic payments are handled by external operators: Stripe Payments Europe, Ltd. and PayPal (Europe). The Foundation does not collect or process payment card data directly.
 
3.3. Nature of Donation: By making a payment, the User concludes a donation agreement with the Foundation.
 
3.4. External Fundraisers: The Portal may contain links directing to collections conducted on external fundraising platforms (e.g., Siepomaga.pl, Zrzutka.pl). In such cases, the donation process is determined exclusively by the regulations of those external portals.
 
3.5. Return Policy: In accordance with the Polish Civil Code, a donation already executed is non-refundable. Revocation of a donation is possible only in strict cases defined in the Civil Code (e.g., gross ingratitude). Mistakes in transfer amounts do not constitute grounds for an automatic refund.

4. Terms of Service

4.1. The User must meet the following technical requirements:
 
4.1.1. access to the Internet;
 
4.1.2. a properly configured web browser (e.g., Chrome, Safari, Edge).
 
4.2. The User acts lawfully and is prohibited from providing content that is illegal or infringes on the rights of third parties.
 
4.3. The Foundation shall not be liable for interruptions in the Service resulting from failures of ICT systems beyond its control (including failures of Stripe or PayPal).
 
5. Complaint Procedure
 
5.1. Complaints concerning the functioning of the Portal may be sent to: info@pus3foundation.org.
 
5.2. A complaint should be submitted within 7 days from the date the cause arose. It should contain a description of the problem and transaction details (if applicable).
 
5.3. The Service Provider shall consider complaints within 14 days of their receipt.

6. Final Provisions
 
6.1. The Regulations shall be in force from the date of their publication.
 
6.2. The Foundation reserves the right to change the Regulations. All changes become effective as of the date of their publication.
 
6.3. In matters not covered in these terms and conditions, Polish law shall apply.
